Sponsor Licence Renewals

Sponsor Licence Renewal rules changed significantly from 6 April 2024. Most Worker and Temporary Worker sponsor licences no longer need to be renewed every four years and will generally remain valid for as long as the organisation continues to meet the relevant Home Office requirements.

However, sponsor licence validity still needs active management. Employers remain responsible for maintaining accurate licence details, meeting sponsor duties, keeping suitable HR systems and ensuring that the organisation remains eligible to participate in the sponsorship system.

The Home Office confirmed that licences due to expire on or after 6 April 2024 generally no longer need a renewal application. For these sponsors, the licence normally remains valid while the organisation continues to satisfy the eligibility and suitability requirements and complies with its sponsor duties.

This does not mean that sponsor licence management has disappeared. A sponsor must still keep its licence information accurate, report relevant organisational changes, maintain appropriate records and systems and comply with the conditions of sponsorship.

Employers should therefore distinguish between the removal of the routine renewal application and the continuing duty to maintain a compliant sponsor licence.

Checking Your Sponsor Licence Status

Sponsors can manage their licence through the Sponsorship Management System. The SMS contains information about the organisation’s licence, sponsored routes, users and other licence details.

Where a business has historically operated under the previous four-year renewal system, it is sensible to check that the current licence record reflects the organisation’s actual position and current sponsorship requirements.

Issues can arise where an organisation has changed name, ownership, structure, address, key personnel or other material details without the position being properly reflected in the sponsor licence.

The absence of a routine renewal requirement does not prevent the Home Office from taking compliance action where the sponsor no longer meets the requirements of the scheme.

Ongoing Sponsor Licence Requirements

A sponsor licence remains conditional on continuing compliance with the sponsorship framework.

Employers must maintain the required records, report specified changes, monitor sponsored workers and use the sponsorship system in accordance with the applicable rules.

Changes within the business can also affect the licence. Depending on the circumstances, changes involving ownership, corporate structure, mergers, acquisitions, premises, key personnel or trading status may require reporting or other action.

Historic Sponsor Licence Renewals

Before 6 April 2024, most sponsor licences were granted for four years and sponsors were required to submit renewal applications if they wished to continue sponsoring workers.

Historical renewal issues can still matter where an organisation allowed a previous licence to expire, failed to renew in time or is dealing with consequences arising from an earlier licence period.

Where the Home Office considers a later sponsor licence application following expiry, the circumstances of that earlier expiry may be relevant.

An employer dealing with a previous lapse should therefore establish what happened, whether workers were sponsored at the time and what steps were taken before considering the appropriate current application or compliance strategy.

What If a Sponsor Licence Has Expired?

The consequences depend on the circumstances and the type of licence involved.

If an organisation previously allowed a licence to expire under the historic renewal system, it may need to consider a fresh sponsor licence application if it now wishes to sponsor workers again.

The Home Office may examine why the earlier licence was allowed to expire, particularly where the organisation simply failed to make a required renewal application in time.

Where sponsored workers or continuing recruitment plans are affected, the position should be reviewed promptly before further Certificates of Sponsorship are assigned or recruitment commitments are made.

UK Expansion Worker Sponsor Licences

The UK Expansion Worker route is different from the normal continuing sponsor licence position.

A UK Expansion Worker sponsor licence is time-limited because the route is intended to support an overseas business establishing a UK presence rather than provide a permanent sponsorship framework.

The licence is normally valid for up to four years. An organisation that has established its UK operations and wishes to continue sponsoring workers may need to consider whether another sponsorship route, such as Skilled Worker, is appropriate.

Employers using the UK Expansion Worker route should therefore plan for the end of that sponsorship period rather than assume that the licence will continue indefinitely.

Scale-up Sponsor Licences

A Scale-up sponsor licence is also subject to a specific four-year limit.

An organisation can only be licensed once under the Scale-up route. The sponsor licence is valid for four years unless surrendered or revoked earlier and cannot be renewed beyond that period.

Where the organisation wishes to continue sponsoring overseas workers after its Scale-up licence ends, it may need to hold or obtain a licence under another route, such as Skilled Worker.

Planning ahead is therefore important where the business expects international recruitment to continue beyond the Scale-up sponsorship period.

Changes to the Organisation

One of the most important aspects of maintaining a sponsor licence is ensuring that changes to the business are dealt with correctly.

Corporate transactions and organisational changes can affect sponsorship. Depending on the circumstances, this can include changes of ownership, mergers, acquisitions, restructurings, changes of legal entity or cessation of trading.

Some changes may be reportable through the SMS. Others may have more significant consequences for the existing licence and sponsored workers.

Businesses involved in a corporate transaction should therefore consider sponsor licence consequences as part of the transaction rather than after completion.

Key Personnel & SMS Management

The sponsor must continue to maintain appropriate key personnel and access to the Sponsorship Management System.

Changes involving the Authorising Officer, Level 1 Users or other sponsorship personnel should be managed carefully and reflected in the SMS where required.

A common practical risk is allowing sponsorship knowledge to sit with one employee who later leaves the organisation. Employers should maintain appropriate internal continuity so that the organisation can continue to meet its sponsor duties.

Home Office Compliance

The removal of routine sponsor licence renewals does not remove Home Office compliance powers.

The Home Office can carry out compliance checks and take action where a sponsor fails to meet its duties or no longer satisfies the requirements for holding a licence.

Employers should therefore treat sponsor licence management as an ongoing compliance function rather than something reviewed once every four years.

Preparing for Future Sponsorship

An employer that expects to continue recruiting internationally should periodically review whether its existing licence includes the sponsorship routes it needs.

A business may need to add another route to an existing licence as its recruitment strategy changes.

It should also consider future Certificate of Sponsorship requirements, key personnel arrangements and whether its HR systems remain suitable as the number of sponsored workers increases.

If Your Sponsor Licence Has Been Suspended or Revoked

Suspension and revocation are separate from ordinary sponsor licence validity.

The Home Office may take enforcement action where it considers that a sponsor has failed to comply with its obligations. A suspension can prevent or restrict the sponsor’s ability to use the licence while the Home Office considers the position, while revocation can result in loss of the licence altogether.

Where a sponsor receives a suspension or revocation notice, the deadlines and reasons given by the Home Office should be reviewed immediately.
